Terms of Service

1. Agreement to Terms

By creating an account, clicking "I agree," or using the OneApplicant website, apps, and related services (the "Service"), you agree to these Terms & Conditions ("Terms"). If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent you have authority to bind that organization.

2. Eligibility

You must be the age of majority where you live (or have parental consent where permitted) to use the Service.

3. What OneApplicant Provides

OneApplicant is a software platform intended to help users create and manage job-application materials. Features may include:

• • Profile/career data management
• • Resume and cover letter drafting, tailoring, and formatting
• • Job description analysis and alignment suggestions
• • Job search and application tracking tools (where available)

No outcome guarantees. We do not guarantee interviews, job offers, acceptance, compensation, or any employment outcomes.

4. No Professional Advice; No Employment Agency

The Service provides drafting and informational assistance only. OneApplicant is not an employment agency, recruiter, or headhunter, and does not provide legal, financial, or other regulated professional advice.

5. Accounts and Security

You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us immediately of suspected unauthorized access.

6. User Content (Your Inputs)

"User Content" includes any information you submit, upload, paste, or otherwise provide (e.g., resumes, job descriptions, work history, education, skills, notes).

You represent and warrant that:

• • You have the rights to provide your User Content
• • It is accurate to the best of your knowledge
• • It does not violate law or third-party rights

7. AI Outputs; User Responsibility; No Reliance

The Service may generate content and recommendations ("Outputs") based on your inputs. Outputs can be inaccurate, incomplete, or unsuitable for your situation.

You agree:

• • You will review and verify all Outputs before using or submitting them
• • You will not rely on Outputs as factual without independent review
• • You remain solely responsible for your applications and submissions

8. Prohibited Uses

You may not use the Service to:

• • Create or submit fraudulent materials (e.g., fake credentials, licenses, employment history, references)
• • Impersonate others or misrepresent qualifications
• • Violate employer rules or third-party platform terms
• • Reverse engineer, scrape, disrupt, or bypass technical limits
• • Upload malware or attempt unauthorized access

We may suspend/terminate accounts for violations.

9. License to Operate the Service

You retain ownership of your User Content. You grant OneApplicant a non-exclusive, worldwide, royalty-free license to host, store, process, and display your User Content only as necessary to provide and improve the Service and generate Outputs you request.

10. Plans, Credits, Billing, and Renewals

Credits

Some features consume credits. Credit costs and feature availability may change over time. Credits:

• • Have no cash value
• • Are not redeemable for money
• • Are non-transferable except where explicitly allowed

Subscriptions

Subscriptions renew automatically unless cancelled before the end of the billing period. Cancellation takes effect at the end of the then-current period unless stated otherwise.

One-time purchases

One-time credit packs (if offered) are subject to the purchase terms shown at checkout.

11. Refunds

Refunds (if any) are governed by our Refund Policy and applicable law. Unless required by law, payments are non-refundable and unused credits are not redeemable.

12. Third-Party Services

We may use third-party services (payment processing, analytics, hosting, AI processing, job data sources, PDF export). Third parties operate under their own terms and policies. We are not responsible for third-party outages or changes outside our control.

13. Intellectual Property

The Service (excluding your User Content) is owned by OneApplicant or licensors and protected by intellectual property laws. You may not copy, modify, distribute, sell, lease, or create derivative works from the Service except as permitted by law.

14. Availability; Changes; Beta Features

We may change, suspend, or discontinue any part of the Service at any time. Some features may be beta/preview and may be modified or removed without notice.

15. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, pose risk to the Service, or as required by law. Provisions intended to survive termination will survive.

16. DISCLAIMERS

THE SERVICE AND OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, ONEAPPLICANT DISCLAIMS ALL WARRANTIES (EXPRESS OR IMPLIED), INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND AVAILABILITY.

17. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• • ONEAPPLICANT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.
• • ONEAPPLICANT'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO ONEAPPLICANT IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) $100 (or local currency equivalent) IF YOU PAID NOTHING.

Some jurisdictions do not allow certain limitations. In those jurisdictions, limitations apply to the fullest extent permitted.

18. Indemnity

You agree to defend, indemnify, and hold harmless OneApplicant and its affiliates, officers, directors, employees, contractors, and agents from claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising from:

• • Your User Content
• • Your use/misuse of the Service or Outputs
• • Your violation of these Terms, law, or third-party rights
• • Any dispute between you and an employer or third party

19. Changes to Terms

We may update these Terms. We will update the "Last Updated" date and provide notices where legally required. Continued use may constitute acceptance to the extent permitted by law.
